Rule 42
Ineligibility for promotion
: (1) Notwithstanding anything contained in rule 40, no armed police officer shall be eligible for promotion in the following cases:-
(a) For suspension during the period of suspension,
(b) For withholding of promotion during the period of withholding of promotion,
(c) In case of suspension of salary increment till the period of suspension of salary increment,
(d) Up to one year from the date of reduction in salary increase,
(e) In case of reduction in the original scale of payment, up to one year from the date of such reduction,
(f) For one year from the date of receiving a sentence of reprimand,
(g) In the case of armed police personnel who go to work in the United Nations or other international organizations with special permission from the Government of Nepal, up to the period specified in the terms and conditions before going to work in that way,
(h) As long as the case is pending in the Special Court for the offense under Section 27 of the Act,
(j) In the case of armed police personnel who have been reinstated once out of service, until they complete the refresher training.
(2) Regardless of what is written in sub-rule (1), after the establishment of the Armed Police Force, the employees employed in the position of Senior Superintendent of the Armed Police who are appointed through open competition in the general subgroup within the general group, shall be APF as per sub-rule (1) of rule 48. The Armed Police will not be eligible to be a candidate for promotion to the post of Deputy Inspector General until the command and staff training is completed.
